Dacheng’s Kunming-based IP Attorneys Represent Client in Patent Validity Dispute

Recently, IP attorneys from Dacheng’s Kunming office successfully represented Yunnan Qifeng Petroleum Machinery Co., Ltd., the defendant, in an IP litigation in the Intermediate People’s Court of Kunming.
 
GK Vibratory Equipment (Beijing) Co., Ltd., the plaintiff, is a WFOE and a world-renowned manufacturer of a series of vibratory machinery for mining. It claimed to hold a patent on a double mass shaker, which was said to be invented by Eric Dickenson, director of the company. In August 2013, GK brought a suit against Yunnan Qifeng Petroleum Machinery Co., accusing it of patent infringement and asking for RMB1mln of compensation. Dacheng attorneys from Kunming office’s IP practice, having conducted a thorough analysis of the patent held by GK, resorted to the Patent Reexamination Board of State Intellectual Property Office to check the validity of the patent. On December 25 2013, the agency ruled that the patent was invalid. Thus, with the help of Dacheng’s attorneys, the Yunnan-based machinery company won a complete victory.
