Introduction

Ms. Mingyue Dun is a recognized leader in the judicial and administrative protection of intellectual property rights (IPRs) in China. She began her practice in the IP field in 1993 when she joined a leading agency providing intellectual property services. Her vast experience has touched on almost every area of IPR for 30 years. She has successfully represented a number of well-known multinational enterprises with the enforcement of their intellectual property rights in Chinese courts, including Exxon Mobil, Hennessy, Motorola, Adidas, Bloomberg, Chevron, Lenovo, University of Pennsylvania, etc. She has aggressively pursued IP counterfeiters by utilizing raid actions in over a hundred cases to promptly stop infringement. To cope with the emerging threat of online counterfeits, she has developed several courses of action for clients to protect their IPR, including online complaints, investigation, administrative action, criminal action, and civil actions. <br><br>Ms. Dun is an innovator who provides her clients with creative solutions to fit their needs. This creativity was utilized while handling the dispute over the trademark right for “Peter Rabbit” between a Chinese publisher and a British company. Her innovative proposal was to seek a declaration judgment on non-infringement, which was the first case of declaration judgment on a trademark dispute in China. In the series of cases that the famous bakery chain “Paris Baguette” faces, while the client does not have a trademark registration and was sued by other company, she creatively advised the client to file a lawsuit actively. In the lawsuit, the client's trademarks in Chinese and English were both recognized as well-known marks, and the activities of the other party was held unfair competition by the court. When she was representing Hallmark Inc., a well-known greeting cards and gift company, the client was in a very disadvantaged position, she helped the client obtain a piece of crucial evidence and succeed in both the trademark registration dispute and the infringement case. <br><br>Ms. Dun is a problem solver and works to counsel her clients on the most efficient and cost-effective methods to achieve their goals.  When clients cannot obtain their goals through legal proceedings she works with them to solve their issues through negotiation or alternative ways.<br><br>Moreover, Ms. Dun has been widely published in professional journals where she provides analysis of legal issues and practical problems in the IP field. She is also the main author of the book, How to Protect Your Brand, published by the Hong Kong Trade Development Council, which provides guidance on brand protection for Hong Kong and mainland enterprises. <br>
