Pascal is a partner of the TMT Practice Group in Dacheng Shanghai office. He has over 20 years of experience advising TMT clients in areas including AI, Internet information service, e-commerce, IT equipment and service, software, cloud computing, chip technology, blockchain, self-driving vehicles, and new energy cars. Pascal assists foreign investors in designing suitable investment and cooperation structures for entering highly regulated sectors in China, enhancing cooperation arrangements with partners, and ensuring the protection of key intellectual property.
Pascal possesses extensive knowledge and practical experience in AI governance, cybersecurity and data protection compliance, reputation governance and crisis management within China. He was recognized by Legal 500 in its Greater China 2025 and 2026 editions as one of specially recommended lawyers in the category of Data Protection, and was commended by the Shanghai Communications Administration in 2024 and 2025 for his outstanding achievements in cybersecurity and data security work in the telecommunications and Internet sector in Shanghai.
Since 2008, Pascal has been providing legal services to Chinese companies on their outbound investments, with a focus on the mining and natural resources industries. He has been seconded to work in a renowned Australian law firm for extended periods. Additionally, he also has considerable experience in foreign-related dispute resolution, and cross-border restructuring, insolvency and bankruptcy matters.
(I) Cybersecurity and Data Protection
Advised multinational companies on user privacy protection, supplier and customer data security management, and internal corporate data security management, including protection impact assessment, compliance audit etc.
Advised multinational companies on cross-border data transfers involved in global IT resources sharing, including the compliant approaches for outbound data transfers such as the security assessment organized by the Cyberspace Administration of China, the personal information protection certification and signing & filing of the Standard Contract for outbound transfer of personal information, and had successfully assisted clients to obtain security assessment results and Standard Contract filing numbers

Advised a leading German carmaker on data compliance due diligence for investing into an e-hailing platform
Advised a world-leading energy/resources consulting firm on its internal legal audit for State secrets compliance in its daily operation
(II) FDI and Transactions
Advised a US optics company on forming a joint venture in Hebei Province, China, US$100m acquisition of a Chinese player, US$115m asset acquisition of a competitor’s pump and high-power laser business and US$88m asset acquisition of its amplifier business
Advised a Chinese company on concluding an exclusive strategic cooperation with a world-leading instant messenger provider for distributing its instant messenger services in China
Advised a leading US big data company on acquiring 90% of a Chinese market research company and setting up a joint venture in China
Advised a state-owned institute on its negotiation with a US counterpart for setting up a joint venture vendor in Jiangsu China for COMAC C919 Aircraft program and conclusion of subsequent product supply and technical support contracts
Advised a leading Canadian hydrogen fuel cell system provider on its cooperation agreement and licensing transaction with its Chinese partner
Advised a leading Canadian petfood company on its daily operation in China and distributor agreements with Chinese distributors
Advised a leading US open-source instruction set architect foundation for chips on its market entry into China and cooperation with potential Chinese partners
Advised a US healthcare e-commerce website on cross-border sales, setting up a China WFOE for opening a local cross-border e-commerce platform to get the Value-added Telecom Service License for commercial e-commerce business (EDI license), and daily operations
(III) Chinese Outbound Investment
Advised a Chinese coal company on its AU$299m acquisition of the exploration rights to a coal project in New South Wales, Australia
Advised a China SSE gold company on its US$275m acquisition of a copper gold project in Laos
Advised a Chinese coal company on its subsidiary’s AU$8bn merger with an ASX company and its subsequent listing on ASX
Advised a ASX copper company on the proposed AU$545m takeover bid by a Chinese mining group
(IV) Dispute Resolution
Represented a German Tier 1 automotive supplier in arbitration over supply agreement disputes at the China International Economic and Trade Arbitration Commission and the Shanghai International Arbitration Centre
Represented a company in the Shanghai Free Trade Zone in filing a jurisdictional objection with the Suzhou Intermediate People's Court over the validity of a SIAC arbitration clause with a company in the Suzhou Free Trade Zone, successfully confirmed the validity of SIAC arbitration clause and got the adverse party's lawsuit dismissed (selected as a representative case of enforcement judgment in 2024 by the Jiangsu Provincial High People's Court, and acknowledged by the Shanghai Bar Association as an outstanding dispute resolution case in 2024)
Represented a foreign-invested advertising company in litigation at the competent court in Shanghai over a series of media purchase contract disputes
Represented a US cosmetics brand in litigation at the Guangzhou Internet Court over reputation right disputes against infringement by a self-media account
Represented a PRC mining company at the Hong Kong High Court over a dispute regarding the outstanding balance under a merger and acquisition contract with a foreign party, successful settled and got the adverse party withdrawing the lawsuit

Advised a U.S. battery energy storage system provider in Chapter 11 proceedings
Advising a Chinese creditor on its recovery in Chapter 11 proceedings
Advised a Chinese power chips foundry on its bankruptcy reorganization project
