Michelle (Yanmei) CHE is a Partner at Beijing Dacheng Law Offices, LLP(Shenzhen). International Trade Disputes: Represented a US Technology company in an international arbitration against a HK company and Shenzhen entities, obtaining a favorable final award; Represented German, Lithuanian, and Chinese Companies in CIETAC and other foreign-related arbitration proceedings, achieving favorable awards, settlements, and withdrawals.
International Logistics Disputes: Represented freight forwarders and supply-chain companies in disputes involving air cargo transportation, international shipping, and Amazons Logistics Services, achieving substantial success in litigations and counterclaims;
International Services Disputes: Represented Client in CIETAC and other arbitral proceedings involving franchise agreements, brand managements, commissioned production agreements, and international service contracts, obtaining favorable awards and settlements.
Shareholders and Corporate Control Disputes: Handle a wide range of shareholder disputes, including shareholder inspection rights, equity ownership, company deregistration, return of company licenses, dissolution actions, and enforcement-related shareholder liability claims. Successfully represented clients in obtaining favorable court judgements or resolving disputes through negotiated settlement mediation.
Technology, Manufacturing & Product Liability: Advised U.S.-listed companies, technology companies, manufacturers, and e-commerce business on global warranty terms, product liability disputes, IP and technology contract disputes, procurement agreements, commercial defamation claims, and plate-form related disputes.
M&A, Investment & Corporate Transaction: Advised projects involving Shenzhen China Merchants Equity Investment Fund, China Resource Group, listed companies, foreign-invested enterprises, and private enterprises. Conducted legal due diligence, issued bilingual legal reports and opinions, and drafted transaction documents for acquisitions involving factories, land, buildings, and International Property in China and Overseas.
Cross-border Family & Inheritance Matters: Represented Hong Kong and Mainland Chinese clients in complex cross-border inheritance and divorce disputes involving company shares, real estate, land, rental income, and other substantial assets.
