Practice Areas
Bin Yuan has extensive experience in resolving foreign-related commercial and maritime disputes, and corporate crisis.

In the field of dispute resolution, Mr. Yuan has represented Trading Companies, Banks, Insurance Companies, Ship Owners, P&I Clubs, Shipyards, Freight Forwarding Companies, and cooperated with international law firms in dealing with large amount of foreign-related commercial and maritime cases. Representative cases include representing a state-owned  bank in Wenzhou to participate in a ship mortgage lawsuit which worth more than 300 Million; represented German ship owner to participate the bankruptcy process of a Chinese shipyard (concerning 100 million debt), represented a well-known European trading company to participate in a commercial lawsuit before Ningbo Intermediate Court; represented Malaysian ship owner responding to the ship illegally detained for retrial in the Supreme People’s Court, represented a Taiwan trading company to deal cases of illegal detain of 48 container cargo, represented a British Protection and Indemnity association to deal with an ocean ship’s collision to the Hangzhou Bay Bridge, represented dozens of foreign insurance companies in Chinese courts, defend a shipyard against huge oil spill claims cases, respond an arbitration case filed in London Court of International Arbitration, and filed a counter-claim for four Chinese companies

Besides, Mr. Yuan successfully handled several cases concerning the recognition and enforcement of offshore arbitration awards, influential cases handled by him include representing a Swiss steel company successfully enforced an arbitral award rendered by International Chamber of Commerce in Beijing in Chinese court.
In the field of non-litigation, Mr. Yuan is experienced in corporate crisis relief, foreign investment, ship financing and general corporate matters. He represented foreign corporates several times to issue legal opinions on bankruptcy, refund guarantee, pre-trial and pre-arbitration injunctions

Publications
Mr. Yuan writes articles for various publications and is often invited to deliver speeches on shipping, corporate and recognition and enforcement of foreign arbitral awards etc. His typical articles include “Enforcement of Beijing-Seated ICC Awards: the Invisible Seat” published in “China Law and Practice” Issue November 2010, “Rule B attachment goes back to tradition: EFTs is not attachable property ---comment on the landmark case SCI v. Jaldhi made by the United States Court of Appeals for the Second Circuit” published in “China Maritime Law Annual” Edition 4. Apart from this, the article “Retreat and Advance of Zhejiang-based Companies against Foreign Arbitration—Also Preliminary Ideas on How Zhejiang-based Companies shall Perfect Defending Mechanism for Foreign Arbitration under backdrop of Marine Economy” jointly written by Mr. Yuan and his colleague won the first prize in the First Zhejiang Lawyers Seminar 2011, and the article “Research on Seller’s Obligations Prior to Ship Delivery in Ship Sales” won the first prize in Ningbo Lawyers Symposium of Practice and Theory 2004.
