Dentons team wins land and housing dispute case for Grupo Bimbo's Tianjin plant

The Mexican manufacturer Grupo Bimbo (Bimbo) is the world's largest food baking company, and its Tianjin plant, with significant investment, is a key production base in China. However, after the plant was built in 2014, some people colluded in using judicial procedures to seriously infringe on the legitimate rights and interests of the company. In July 2015, Bimbo retained a Dentons Beijing team led by senior partner Wang Yu to resolve the land and housing dispute. Mr. Wang was supported by partner Tang Xiaoqin and associate Wang Ding.

At the beginning, the company, as the defendant of the lease contract dispute case, was not only facing the malicious collusion between the plaintiff and the original owner of the land and housing (the first defendant), who attempted to use the principle of "sales not devastating lease" to forcibly occupy the whole factory, but also faced with the difficulties in collecting evidence and the intentional partiality of the officials of the court of first instance.

Despite of the various difficulties and unfavorable situation, the Dentons team first excluded some of the land and housing involved in this case from the examination scope of the whole case in the second instance, which achieved the purpose of partially correcting the serious misjudgment of the first instance. Subsequently, the team filed a lawsuit for eliminating the nuisance and returning the original asset to request the court to assist in the transfer of relevant evidence in this case. Finally, on August 6, 2018, after the unremitting efforts of the team, the Tianjin No. 2 Intermediate People's Court made a retrial decision that the court found that the plaintiff and the first defendant colluded and falsely litigated, seriously jeopardizing the legitimate rights and interests of Bimbo. The court finally revoked the first-instance and second-instance decisions made by the court and the Tianjin Binhai New Area People's Court, and fully rejected the plaintiff's claim. At the same time, the outlaws involved in this case have been subjected to criminal coercive measures for false litigation, and the criminal case has entered the procedure of prosecution examination by the procuratorate.

Under the guidance of his mentoring partner Wang Yu, associate Wang Ding conducted a thorough analysis of all the facts, evidence and laws involved in this case, and never left off any clues involved and the judgment documents. He finally made major breakthrough in the finding of the basic facts and evidence, making an important contribution to the final correction of the case. The client also spoke highly of him.

This case has been listed by the Tianjin judicial system as a 2018 typical case of preventing false litigation and improving the business environment for enterprises, and was publicized within the courts in Tianjin city.
